If you are planning to set up an industrial unit in Karnataka,
you need clearance from the Karnataka State Pollution
Control Board (KSPCB). Pollution control clearance is the
final step in the procedure for approval of setting up an industrial
unit. The first go-ahead is given either by the state-level
Single Window Agency or the district level one, depending upon
the type of industry.
If the industry has invested up to Rs 50 crore on plant and
machinery, the state level agency gives its clearance. Approval
of investment above Rs 50 crore is done by the Large and Medium
Scale Industries' high-level committee. District Single Window
Agency gives clearance to industrial units with investments
up to Rs 1 crore. However, these clearances are given only in
principle. Formal approval is given by the KSPCB under Section
25 of Water (Prevention & Control of Pollution) Act, 1974,
and Section 21 of Air (Prevention & Control of Pollution)
Act, 1981.
Subject to the provisions of Section 25 of the Water Act, no
person shall, without the KSPCB's consent, take steps to establish
any industry, operation or process, or any treatment and disposal
system which can discharge sewage or trade effluents in a stream/well/sewer/land.
Similarly, no person shall establish or operate any industrial
plant in an air pollution-control area.
Application Form
Application for consent of KSPCB is made, accompanied by a certain
fee structure, in a prescribed form. The prescribed format is
available as Form I of the Air Act and Form XIII of the Water
Act, addressed to the KSPCB's member secretary through the environment
officer/deputy environment officer (to be submitted in triplicate).
Fee Structure
The fee structure varies from Rs 100 to Rs 2 lakh, depending
on the type (capital investment) and the pollution potential
of the industry.
Pollution Potential
The pollution potential can be classified into Red (highly
polluting), Orange (medium polluting) and Green (less
dangerous) industries.
Time frame for Clearance
The time frame for clearance again depends on the type of industry.
The 'Orange' and 'Green' industries are cleared by the Board
members themselves. For the 'Red' industries, the Board conducts
a public hearing. After getting KSPCB's consent, the applicant
must obtain a 'consent of operation' 45 days in advance from
the board. Form I (for air pollution) or Form XIII (water pollution)
must be filled once again, depending on the sources of pollution.
Inspection by KSPBC
After clearance, the KSPBC conducts spot inspections. Frequency
of inspection for large and medium scale industries varies from
one to six months, while small scale industries are inspected
once in a year or two.
Renewal of License
Licenses for large scale/Red industries must be renewed
every year, medium scale/Orange-Green industries in two years
and small industries once in three years. The licence renewal
procedure again involves filling Form I and Form XIII.
For industries enlisted under Hazardous Waste Management (HWM)
and Handling Rules for Environment Protection Act, a separate
authorisation has to be obtained from the Board, which is renewable
once in five years.
